Understanding Holiday Entitlement

In the UK, almost all workers are legally entitled to 5.6 weeks of paid holiday per year. This is known as statutory leave entitlement or annual leave.

Key Points

  • Full-time workers: 5 days × 5.6 weeks = 28 days (this is also the statutory maximum)
  • Part-time workers: Days per week × 5.6 weeks
  • Bank holidays: Can be included in the 28 days or given additionally
  • Contract terms: Employers can offer more than the statutory minimum

Who Is Entitled?

Almost all workers are entitled to statutory paid holiday, including agency workers, workers with irregular hours, and workers on zero-hours contracts. The only exceptions are genuinely self-employed people.

What is the statutory holiday entitlement in the UK?

The statutory minimum paid holiday entitlement in the UK is 5.6 weeks per year. For someone working 5 days a week, this equals 28 days (5.6 × 5 = 28 days). This can include bank holidays at the employer's discretion.

How is part-time holiday entitlement calculated?

Part-time workers are entitled to the same 5.6 weeks of paid holiday as full-time workers, but pro-rated. For example, if you work 3 days per week, you'd be entitled to 3 × 5.6 = 16.8 days of paid holiday per year.

Are bank holidays included in statutory holiday?

Employers can choose whether bank holidays are included in your statutory 28-day entitlement or given in addition to it. Check your employment contract for details.

How do I calculate holiday for someone who started mid-year?

For employees who start mid-year, calculate the proportion of the year they'll work and apply that to the full annual entitlement. For example, starting on 1 July = 6/12 of the year = 50% of annual entitlement.

Can I carry over unused holiday to the next year?

By law, you must be allowed to carry over holiday you couldn't take due to maternity leave, sick leave, or if your employer refused your request. Otherwise, carrying over unused holiday depends on your employer's policy.
