What is the statutory notice period in the UK?
Statutory notice is the legal minimum notice period. For employees with less than 1 month's service, there's no statutory minimum. From 1 month to 2 years, it's 1 week. After 2 years, it's 1 week for each complete year of service, up to a maximum of 12 weeks after 12 years.
Can my employer give me less than statutory notice?
No, employers must give at least statutory notice unless dismissing for gross misconduct. They can pay in lieu of notice (PILON) instead of having you work the notice period. Your contract may specify a longer notice period, which must be honored.
How much notice do I need to give when resigning?
When resigning, you must give at least the notice specified in your contract. If your contract doesn't specify, you should give at least 1 week's notice after 1 month of employment. There's no statutory minimum for employee notice when resigning.
What is garden leave?
Garden leave is when you remain employed during your notice period but don't come to work. You continue to receive full pay and benefits. It's often used for senior employees or those with access to sensitive information. You remain bound by your contract terms during garden leave.
Can I be made to work my notice period?
Generally yes, unless your employer agrees to waive part or all of your notice. Leaving without working your notice could be breach of contract, potentially allowing your employer to claim damages (though this is rare in practice).
What happens to my holiday during notice?
You continue to accrue holiday during your notice period. Your employer may require you to take outstanding holiday during notice. Any untaken holiday must be paid out in your final pay. You cannot use holiday to shorten your notice without agreement.
