  • Part-time workers
  • Agency workers
  • Casual workers
  • Zero-hour contract workers
  • Piece workers
  • Home workers

Exceptions include:

  • Genuinely self-employed people
  • Volunteers

What if my employer pays less than minimum wage?

If you believe you're being underpaid, you can:

  4. Report to HMRC anonymously

HMRC can order employers to pay arrears and issue penalties up to 200% of the underpayment.

Does overtime count towards minimum wage?

All hours worked must be paid at least at minimum wage. However, minimum wage is calculated as an average across the pay reference period, not per individual hour.

What about tips?

Tips, gratuities, and service charges cannot count towards minimum wage pay. They must be paid on top.

Employer Obligations

Employers must:

  • Pay at least the correct minimum wage rate
  • Keep accurate records of hours worked
  • Display a minimum wage poster in the workplace
  • Not make deductions that take pay below minimum wage (e.g., for uniform)
